data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>La Direttiva Omnibus (Direttiva UE 2019\/2161) \u00e8 la normativa europea che ha rafforzato la trasparenza dei prezzi e la tutela del consumatore negli acquisti online. In Italia \u00e8 stata recepita con il <strong>D.Lgs. 26\/2023<\/strong>, che ha introdotto l&#8217;<strong>articolo 17-bis del Codice del Consumo<\/strong>.<\/p><p>La regola centrale riguarda gli annunci di riduzione di prezzo: ogni volta che comunichi uno sconto, devi indicare anche il <strong>prezzo precedente<\/strong>, definito come il <strong>prezzo pi\u00f9 basso che hai applicato nei 30 giorni precedenti<\/strong> alla riduzione. Non \u00e8 quindi sufficiente barrare il prezzo di listino: il riferimento da mostrare \u00e8 il minimo effettivo dell&#8217;ultimo mese.<\/p><p>L&#8217;obbligo si applica alle campagne promozionali dal <strong>1\u00b0 luglio 2023<\/strong> in Italia (la data di applicazione a livello europeo era il 28 maggio 2022) e riguarda sia gli eCommerce sia i punti vendita fisici. Il prezzo di riferimento da esporre accanto allo sconto non \u00e8 il prezzo pieno di listino, ma il <strong>valore minimo realmente applicato alla generalit\u00e0 dei consumatori nei 30 giorni che lancio, ai programmi fedelt\u00e0 e codici sconto personali e ai prodotti agricoli e alimentari deperibili.\t\t\t\t\t<\/p>\n\t\t\t\t\n\t\t\t<\/div>\n\t\t\t\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-27752c9 elementor-widget class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Gestire correttamente questo calcolo significa conservare lo <strong>storico prezzi<\/strong> di ogni SKU, identificare il minimo nella finestra mobile di 30 giorni e propagarlo come prezzo di riferimento su ogni canale \u2014 per ogni prodotto, ogni giorno.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-dfe5c51 e-flex ingannevoli<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-dee35d2 elementor-widget elementor-widget-text-editor\" data-id=\"dee35d2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>La conformit\u00e0 non \u00e8 un dettaglio formale. L&#8217;art. 17-bis prevede sanzioni amministrative <strong>da \u20ac 516 a \u20ac 3.098<\/strong>, che possono salire <strong>fino a \u20ac 10 milioni<\/strong> nei casi di informazioni ingannevoli sulla riduzione di prezzo.<\/p><p>\u00a0<\/p><p>L&#8217;<strong>AGCM<\/strong> (Autorit\u00e0 Garante della Concorrenza e del Mercato) ha gi\u00e0 avviato istruttorie e comminato sanzioni a eCommerce per sconti fittizi \u2014 promozioni in cui il prezzo &#8220;barrato&#8221; non rifletteva il reale minimo dei 30 giorni precedenti.
